1) General conditions for the purchase of products and/or services www.arueyewear.it

The website www.arueyewear.it is owned by Aru Srl, with registered office in Via Casale, 5 20144 Milan (MI), Italy. The use of the site by the user is subject to these conditions and access to the site presupposes recognition and acceptance of all the Conditions of Sale. arueyewear. it does not provide any guarantee of any kind (express or implied) regarding the accuracy, completeness and reliability of the information, software, services and in general the content of the site, with the exception of what is mandatory under consumer protection laws. www.arueyewear.it will be updated daily and expressly reserves the right to modify, in whole or in part, at any time and without notice, any part of the website. The offer of products and services of arueyewear.it is addressed to both consumer users and other users. Users are those who purchase products or services presented on the site for purposes unrelated to their business or professional activity in accordance with the provisions of Legislative Decree no. 206 of 6 September 2005.

 

2) Contract of Sale – Purchase of Products

The representation of the images of the products visible on the website arueyewear.it generally corresponds to the photographic image of the same with the sole purpose of presenting them for sale, without any warranty or commitment, explicit or implied by www.arueyewear.it about the exact correspondence of the image depicted on the site with the real product, especially with regard to the size and / or color aspects of lenses and frames. In each product page there is in addition to the images a description as detailed as possible about the coloring of lenses and frames but in no way arueyewear.it is responsible for what is described. Every sale of products or services will be archived by arueyewear.it through an electronic system and can be viewed, where necessary, both by the staff of www.arueyewear.it and by any third parties that it uses for the execution of related services, shipping, billing, warehouse management.

3) Price of products and services www.arueyewear.it – Availability of Products

The prices published on each page of the website www.arueyewear.it are inclusive of VAT. To the price of each product and/or service may be added the cost of each shipment (if any), whose amount may vary depending on the mode of delivery and payment, as well as in relation to the purchase price of the product.
For amounts over euro 200,00 the shipment is totally charged to Aru Srl. The total amount due for shipping will be clearly indicated and communicated to the Customer, before the conclusion of the Contract of Sale (in the cart). In case of amounts lower than euro 200,00 the shipping price will be indicated during the purchase. The average shipping time and shipping methods for Italy, are described and illustrated on the page of the website “Free Insured Shipping”.
The Prices shown on the Site are subject to possible variations and/or changes by www.arueyewear.it without any obligation to notify the Customer. Such increases may depend – among others – on increases decided by the suppliers of arueyewear.it. The availability of the products is subject to the availability of our central warehouse and the manufacturer. arueyewear.it ships in 24/48 hours. Normally the products are available in 5-7 working days. Statistically in 4 days the order is shipped. The order to the supplier is automatic but the delivery times of the distributors can exceed the contractual delivery terms. Each product purchased will be shipped with regular sales invoice, CE manufacturer’s warranty, 24 months warranty (for manufacturing defects), case of the brand purchased and microfiber / cleaning cloth (where applicable).

4) Methods of payment

The types of payment accepted by www.arueyewear.it are:

Payment through Paypal will be made by redirecting to the Paypal site, where the procedures for the transfer of sums due to arueyewear.it can be completed. The Customer’s financial data will be managed directly by Paypal and will not be shared with www.arueyewear.it. For those who use credit cards, arueyewear.it has chosen the electronic payment circuit of PayPal. To ensure maximum security in payments, online transactions of purchases on arueyewear.it paid by credit card are made with certification, through Secure Server that adopts the SSL (Secure Socket Layer) protection system. This system takes care of encrypting the information typed, so as to make it impossible to intercept them by external users. When paying the order by credit card, arueyewear.it will automatically send to a secure page (SSL) of the PayPal website that will take care of the transaction. In this page you can enter the card data (number and expiration date) in an ABSOLUTELY SECURE way. The data are in fact directly transmitted to PayPal, offering the maximum guarantee. arueyewear.it does not receive and does not retain any credit card number, therefore it is released from any kind of responsibility deriving from the transaction that takes place directly between the customer and the credit institution/payment system. When you purchase an item on arueyewear.it the charge is made at the time of order processing by an appointed customer. arueyewear.it would like to emphasize that no credit card data is visible to any person in charge of our website but that the card data are faithfully kept only by the credit institutions.

5) Right of withdrawal by Aru Srl

Pursuant to art. 64 et seq. of the Consumer Code, the Consumer has the right to withdraw from the purchase without penalty and without specifying the reason. To this end, he must send communication to the Customer Service of arueyewear.it by email or alternatively by fax or registered letter to be sent within 10 days of receipt of the chosen products. E ‘accepted without hesitation the return of any item, provided that it is in perfect condition and sealed, free of any kind of wear, nor ruined, nor scratched, refunding the entire amount. The Italian law prescribes that the costs of packaging and shipping are to be borne by the customer, in this case, the costs will be borne by us.

So it is advisable to wear the glasses, try it on, see how it fits, and once you decide not to keep it, send it to the owner’s office: Aru Srl – Ufficio Resi – Via Casale, 5 – 20144 Milano (MI).

It is important that you try the quality and comfort of a pair of Aru Srl glasses, and then make a final decision.

Aru Srl will not be liable in any case for damage, theft or loss of the returned items, until the return of the same. Any risk will, therefore, be borne exclusively by the customer. Please note that the items must be returned to the following address: Aru Srl – Ufficio Resi – Via Casale, 5 – 20144 Milano (MI). We recommend the return of the item through a traceable shipment. arueyewear.it is not responsible for lost or damaged parcels during the transit of the return. Please note that shipping and packaging costs are not refundable. Once verified the integrity of the returned product, arueyewear.it will refund the amount paid by the customer within and no later than 30 days of receipt of the returned product by credit card or bank transfer (at the discretion of Aru Srl).

6) Privacy Policy

arueyewear.it, according to article 13, informs that all data will be treated in respect and in compliance with the D. Lgs. 30 June 2003, n. 196, (“Code regarding the processing of personal data”) May also be stored some anonymous data on access to the site for purely statistical purposes. Access to the site presupposes recognition and acceptance of the privacy policy. Users are therefore expressly forbidden to modify, distribute, transmit, publish, market, license, copy or use the Contents for commercial purposes without the prior written consent of arueyewear.it. All trademarks, logos and other distinctive signs of any kind used in the Site belong to arueyewear.it and/or their respective owners. The use of the trademarks by the user, in any way and for any purpose, including reproduction on other websites, is expressly forbidden without the prior written consent of Aru Srl or the legitimate owners. The images, descriptions, colors and all technical details of each individual pair of glasses are purely indicative. Aru Srl reserves the right to update the site at any time without prior notice.

9) Reference legislation – Jurisdiction

These Terms of Use of Aru Srl are governed by Italian law as well as each Contract of Sale and subject to Italian jurisdiction. Any dispute relating to the Terms of Use of ARU Srl or the Sales Contracts will be under the exclusive jurisdiction of the Court of Milan (MI), without prejudice to the applicability of mandatory rules of law for the protection of consumers.
